An Overview

As per the DGFT notification No.56/2015-2020 dated 28.01.2021 the Government of India has amended the import policy of different kinds of coal including anthracite, bituminous, coking, and steam and made the compulsory registration under Coal Import Monitoring System (CIMS).

The Commerce and Industry Ministry Mr. Piyush Goyal has launched CIMS, under which coal importers will have to provide advance information about the imports and obtain a registration number/CIMS License, to have effective foreign trade policy interventions.

The CIMS came in effect from 1st April 2021, i.e. the Bill of entry filed on or after 1st April shall be governed by CIMS. The online registration has been started since 15th February 2020 to obtain the registration number.

The registration has to be done not earlier than the 60th day and not later than the 15th day before the expected date of arrival of the import consignment.

Legal action would be taken including the action under FTDR Act, 1992 for the steel importers who are failing to register under SIMS in advance or found to furnish wrong data in the online system.

    Import of coal products in Chapter 27 are subject to compulsory registration under COAL IMPORT MONITORING SYSTEM (CIMS).
 

Objective of CIMS

The objective of introducing the CIMS is to enable the Government of India to maintain and update constantly a database containing the advance information of coal products imported in India.

The data received through the CIMS help the Government in effective policy formulations and implementations regarding steel imports.

Fee Requirement and Validity of registration number/CIMS License

The application fee of Rs. 1 per thousand subjects to a minimum of Rs. 500/- and a maximum of Rs. 1 Lakh on the CIF value of import required to be paid through the online system.

The validity of the Registration number or CIMS license would be 75 days from the approved date.

Procedure to get the registration number/License under CIMS

  • The online application has to be done on Government’s official website for import under the import monitoring system (IMS).
  • Under the Ministry of Coal tab click on Coal Import Monitoring.
  • After clicking on Coal Import Monitoring, there would be the option to get the registration number on the new page.
  • Start filling with the required details shared above.
  • Multiple products can be added in one application if exporter, importer, country of origin, port of exportation is same.
  • For each shipment license has to filed.
  • Accept the terms and conditions on declaration tab.
  • Submit the application after paying the registration fee.

The registration number /CIMS license would be generated immediately as the application is submitted on the portal.

The steam coal importers only have to enter the registration number and expiry date of the registration number in the bill of entry.

Modification/Cancellation of registration number/CIMS license

Modification of the license under CIMS is not permitted once the application submitted on the portal. The draft online application details can be modified from draft section on the website.

Same for the cancellation, the cancellation of license is not permitted once it is submitted. The draft application can be deleted from the portal.

There is no provision given for the fee refund after the cancellation.

Modification, cancellation, refund of fee post submission can be evaluated in near future when the CIMS system would be enhanced.

What does CIMS stand for?

CIMS stands for Coal Import Monitoring System.

Yes, a CIMS license is required for each shipment/customs entry.

There are the specific products from Chapters 72, 73, and 86 are covered under SIMS.

The validity period of an RCMC varies and is mentioned on the certificate. While applying for RCMC, you have an option to choose the validity like 1 year, 2 year, 3 years or 5 years. It is important to keep track of the expiration date and initiate the renewal process before it expires.

Yes, all the Steam coal imports entering the country need licenses under CIMS.

The application has to be done prior to submitting the Bill of Entry in customs. It should be filled in between 15 days to 60 days before the expected arrival of the imports into India.

Can we include multiple products in one license application?

Yes, multiple products can be included in one application.

The CIMS license/registration numbers are generated immediately after completing the application and final submission.

At Present, there is no provision for the modification of the existing CIMS License.

The draft application to get the license or registration number can be deleted on the portal, once it is submitted can’t be canceled.

Legal action would be taken including the action under FTDR Act, 1992 for the coal importers who are failing to register under CIMS in advance or found to furnish wrong data in the online system.
